Authority to Appear and Legal Representation at Hearings

  1. Persons who desire to appear or be legally represented at any public hearings of the Commission should write to the Director of the Commission by no later than 5.00pm on Wednesday 27 May 2015 seeking leave to appear. The written application shall be forwarded by email to mailbox@granthaminquiry.qld.gov.au
  2. The application for leave should:
    1. Identify the person who desires to appear or be legally represented;
    2. Specify those parts of the Commissions of Inquiry Order (No.3) 2015 in which the person is interested or in respect of which it is said that their interests may be materially affected by the Inquiry;
    3. Identify the grounds on which it is said that the interests exist or the grounds on which it is said that the interests may be materially affected;
    4. If it is desired that a legal practitioner should be given authority to appear to represent a person, then the names of the relevant lawyer proposed should be given; and
    5. An email address and telephone number for correspondence.
  3. Where an application for authority to appear is received in accordance with this guideline the Commission shall either:
    1. Determine the application on the written material provided and notify the person or their nominated legal practitioner accordingly; or
    2. Notify the person or their nominated legal practitioner that they will be required to attend at a hearing of the Commission on a date to be advised for further consideration of their application.
  4. Any authority to appear or be legally represented may be varied or withdrawn or made subject to conditions at any time at the discretion of the Commissioner.
  5. Any person summoned to attend before the Commission to give evidence pursuant to the Commissions of Inquiry Act 1950, section 5(1)(a) may be represented by a legal practitioner while that person is giving evidence.
  6. This guideline may be subject to variation or replacement at any time.
